How We Can Help

Our Sydney property offence lawyers represent clients in a wide range of matters, including:

  • Larceny (stealing) and shoplifting offences
  • Break and enter and burglary charges
  • Robbery and armed robbery offences
  • Malicious damage to property
  • Goods in custody matters
  • Receiving stolen property charges
  • Property offences arising from disputes or allegations
  • Youth and first-time property offences
  • Repeat property crime charges

Our lawyers carefully review police evidence, CCTV footage, witness statements, and search procedures to identify weaknesses in the prosecution case.

Why Early Advice Matters

Property offence charges can result in criminal records, imprisonment, and long-term consequences.

Getting early legal advice may assist with:

  • Reducing or withdrawing charges
  • Avoiding a criminal conviction
  • Challenging police evidence or identification
  • Improving sentencing outcomes
  • Negotiating charge reductions

Delaying advice can limit your defence options and reduce your ability to challenge the allegations effectively.

  • Police interviews and initial investigations
  • Bail applications
  • Negotiations with police prosecutors
  • Local Court and District Court appearances
  • Defended hearings and trials

PS My concerns have now been addressed by Vince D'Arcy in a courtious and helpful manner. Thank you Vince for addressing and resolving all issues. Agnieshka Kiera I am disappointed with services of Chris Peacock as a lawyer. He prepared my simple will, charged over $500 and made a lot of critical mistakes in spelling my name even though I provided the relevant ID documents. I asked him and his secretary to fix it, to which they responded that I would have to pay $100 extra for it!!! Paying for fixing their own mistakes??? I said no, yet I am now left with the faulty will or a prospect to pay somebody else to fix their errors. Or find another competent lawyer to re-write the will. So if you want to spare a similar experience, make sure you DON'T pay Chris Peacock, until you are satisfied, you've got what you wanted and what they charge for.

Common Theft and Property Defence Questions Answered

Find answers to some of the most common questions about theft and property defence matters and your legal options in NSW.

Do I need a lawyer for a property offence charge?

Yes. Property offences such as theft, break and enter, and robbery can result in criminal records and imprisonment. Early legal advice can significantly improve your outcome.

What is considered a property offence?

Property offences include a range of charges such as larceny (stealing), break and enter, robbery, malicious damage, goods in custody, and receiving stolen property.

        Can property charges be dismissed?

Yes, in some cases charges can be withdrawn or dismissed if there is insufficient evidence, issues with identification, or problems with how police obtained evidence.

        Can drug charges be dismissed?

Yes, in some cases charges can be withdrawn or dismissed, particularly where evidence is weak, unlawfully obtained, or there are procedural issues.

        What is larceny (theft)?

Larceny refers to unlawfully taking property belonging to someone else with the intention of permanently depriving them of it.

What happens if I am charged with break and enter?

Break and enter is treated seriously in NSW and can carry significant penalties. The outcome depends on intent, circumstances, and the evidence available.

Can I go to jail for property offences?

Yes, serious property offences such as robbery or aggravated break and enter can result in imprisonment. However, outcomes vary depending on the facts of the case and your background.

What if the property wasn’t in my possession?

Possession and knowledge are key elements in many property offences. These issues can often be challenged depending on the circumstances.

Can I avoid a criminal record?

In some cases, yes. The Court may deal with the matter without recording a conviction, depending on your history and the seriousness of the offence.

What should I do if police contact me?

You should seek legal advice before answering questions or participating in an interview. Anything you say may be used as evidence.

How much does a property offence lawyer cost?

Costs vary depending on the complexity of the matter and whether it proceeds to a defended hearing or trial. We provide clear advice on fees after an initial consultation.
